For ease of reference, all the features and functionality of the Climate Habits app (my.climatehabits.co.uk), website (climatehabits.co.uk and associated subdomains) and online groups, together with all its content (whether accessible wirelessly, electronically or downloadable for printing) shall be referred to herein as the service.

This service is maintained for your personal use and viewing. The access and use of the service featuring these terms and conditions constitutes your acceptance of these terms and conditions. They take effect from the date on which you first use this service.

You agree to use this service only for lawful purposes, and in a manner that does not infringe the rights of, or restrict or inhibit the use and enjoyment of, this service by any third party. Such restriction or inhibition includes, without limitation, conduct which is unlawful, or which may harass or cause distress or inconvenience to any person, and the transmission of obscene or offensive content or disruption of normal flow of dialogue within this site.

You are prohibited from posting or transmitting via this website any unlawful, defamatory, obscene, offensive or scandalous material, or any material that constitutes or encourages conduct that would be considered a criminal offence, likely to give rise to civil liability, or otherwise violates any law. Governing law

These terms and conditions shall be governed by and construed in accordance with the laws of England and Wales. Any dispute arising under these terms and conditions shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Climate Habits is the “data controller”. This means that we are responsible for any of your personal data that we collect or use.

Personal data

Personal data we collect

Most of the personal information we collect and process is provided to us directly by you, though you may initially have been invited to join our service by your employer who will have provided us with your name and work email address for this purpose. This includes:

  • Personal identifiers, such as your name, email address, organisation name and mobile phone number. This is collected or verified as part of your enrolment on our service.
  • Information on how you use this website.  This includes IP address and analytical cookies used to understand how users interact with this website. Further information on which cookies we use and why can be found in the section of this document relating to Cookies.

How we use your data

We will use your personal information to enable us to carry out our functions as a service provider to you. In this instance, your information will be used to help you choose and manage the actions you select as part of the Climate Habits service. This includes:

  • Providing you with a personal goals list area where you can add, remove, and change actions you have chosen, and mark them as complete
  • Enabling you to add your own personal custom actions to your own goals list (these are not shared with other users by us)
  • Analysing the usage and performance of the service, and reporting to our clients on the aggregate status, progress and impact of groups of participants using it, including participation rates by organisation (not including the specific actions you choose personally or your contributions to group discussions)
  • Inviting you to give feedback and optionally a testimonial about your experiences of the programme
  • Inviting you to follow updates from Climate Habits after your programme finishes, for example inviting you to join other social media groups or email lists for which we will ask for your explicit consent separately

The Climate Habits programme may include other optional tools managed by third parties, for example for group chat or online meetings. You should refer to the terms of use for those services for questions about how your data will be used if you choose to use them.

How we use cookies

When you use our service, we may collect tracking information such as your browser type, the type of operating system you use, the name of your internet service provider and pages visited on the site.

We obtain this information by using technologies, including cookies, to increase the functionality and user-friendliness of our service and to better tailor it to your needs. For example, we may want to know how long the average visitor spends using the service or which sections get the most attention. Information such as this will only be used in aggregate form and does not identify you personally.

We have no control over cookies that may be added by third party sites linked from content on our service. We advise you read the privacy policies and cookie policy information on any third party sites you visit.

Performance of a Contract

Occasionally, we may also rely on Performance of a Contract, where the processing of your data is necessary to perform a contract we have agreed with your employer, and/or where participation in workplace initiatives is treated as part of your duties under your own terms of employment with them.

The lawful basis that we rely on to process your personal data will determine which of the following rights are available to you.

What will happen if you do not provide this data

If you do not provide email information, you may not be able to receive login details and use the service. You do not need to provide mobile phone information in order to use the service, although you will not be able to access the full service unless you do.

Who your data will be shared with

We may share this information with our suppliers who are managing this service and may need to process it to deliver the service we have asked them to provide. Our suppliers’ contracts with Climate Habits include clauses governing the limited purposes for which they may use the data they process on our behalf. Climate Habits and our suppliers won’t make your personal data available for commercial use without your specific permission.

How long your data will be held for

We will only retain your personal data for a maximum of 1 year.

Automated decision making or profiling

We will not use your data for any automated decision making or profiling. Where we invite you to set goals or express preferences, these may be used to provide you with the more relevant information as part of the service.

Transferring your data outside the UK and how it will be protected

Your data will be stored in the UK/EEA or jurisdictions with arrangements in place which satisfy regulators’ data adequacy requirements (for example, US under the UK-US Data Bridge Regulations).

Where we provide links to websites of other organisations, this privacy notice does not cover how that organisation processes personal information. We encourage you to read the privacy notices of the other websites you visit.

Your data protection rights

You have rights over your personal data under the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018 (DPA 2018).
